CHAPTER 1INTRODUCTION
1.1 Research orientation
Disputes are inevitable in daily life and have a negative influence on interpersonalharmony and even social harmony.Accurately identifying the issues is an importantpart of effectively resolving disputes.The significance of issue identification has beenmentioned in mediation studies(Liebmann,2000;Nolan-Haley,2012)as well as inthe experiences shared by mediators in practice1.However,existing research is moreconcerned with issue identification during the litigation process(Huang,2013;Xi andZhang,2018;Feng,2017;Li and Yan,2021).Research on the issue identification inmediation is needed since mediation is an effective alternative dispute resolutionsystem.
Taking the DIT,a new perspective of discourse analysis,this study attempts toanalyze how the hostess as fact investigator(hereafter referred to as the HFI)identifies issues via information digging in the Gold Medal Mediation2(hereafterreferred to as the GMM).More specifically,it endeavors to investigate the features ofinformation digging in issue identification,conclude the ways of information diggingin issue identification,and explore the effects of information digging.It is hoped thatthis study could shed some light on issue identification in mediation and improve theefficiency of dispute resolution.
1.2 Rationale
The present study is motivated mainly by two reasons.
To start with,it is necessary to explore how to identify issues effectively whenresolving disputes by mediation from a linguistic perspective,especially a discourseinformation perspective.Mediation is a non-adversarial dispute resolution system.Mediation provides a neutral and confidential setting where both parties can openlydiscuss their view on all the issues important to the parties,not just the underlyingones bringing the parties to the table in the first instance.This kind of open and honestcommunication promotes improved communication and understanding and provides afuture-oriented resolution.A win-win outcome for both which is mutually agreed maybe more likely to be achieved.One of the prerequisites for the realization of the aboveadvantages of mediation is that the mediator should accurately grasp the issues andcarry out targeted persuasion and discussion around the issues.In the past,theresearch on issues was mainly a discussion among scholars in the field ofjurisprudence on topics such as building a better issue identification(争点识别)system in the legislative aspect and standardizing and improving techniques for issueidentification in the judicial aspect(Xi&Zhang,2018;Han,2016;Feng,2017;Li&Yan,2021).However,the role of issues in mediation,which is also a dispute-resolution mechanism,has been disregarded in academia.Mediation practitioners3have stressed the necessity of focusing on the issues as they share their experience butlittle has described the concrete process of issue identification stepwise and thediscursive techniques used in the process4.
CHAPTER 2LITERATURE REVIEW
2.1 Introduction
TV mediation shows have moved mediation sessions onto the stage(Deng,et al.,2013).Therefore,TV mediation has the characteristics of mass media at thesame time maintains consistency with the“off-stage”mediation in the basic attributes,principles,and procedures.This chapter first surveys the key previous study onmediation and the special mediation type“TV mediation”.Then previous study on theissues,issue identification and information digging is presented.The reason why theterm“information digging”and“issue identification”is adopted in the current studyis explained.The DIT and related study are also reviewed to lay a foundation for theanalytical framework and relevant analysis of the current study.Finally,this chapterproceeds to discuss the possible limitations of previous studies.
